General terms and conditions of online party shop "Las Fiestas"

1. Applicability

1.a These General Sales Conditions (hereinafter: conditions) apply exclusively to all offers, orders, and agreements of Party Shop Las Fiestas, to the exclusion of any other general terms and conditions.

1.b Accepting an offer or placing an order implies that you accept the applicability of these conditions.

2. Offers/agreements

2.a All offers from party shop "Las Fiestas" are non-binding, and Las Fiestas expressly reserves the right to change prices, especially when necessary due to regulations.

2.b An agreement is only established after acceptance of your order by Las Fiestas. Las Fiestas is entitled to refuse orders or attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, Party Shop Las Fiestas will notify you within 7 working days after receiving the order.

3. Prices and payments

3.a The stated prices for the offered products and services are in Euros, including VAT and excluding shipping costs, any taxes or other levies, unless stated otherwise or agreed in writing.

3.b Payment must be made before an order is shipped!!!

3.c Payment can be made by bank transfer, Bancontact, or payment buttons (KBC,...)

3.d If you are in default with any payment, Las Fiestas is entitled to suspend or terminate the execution of the relevant agreement and related agreements.


4. Delivery

4.a The delivery times stated by Las Fiestas are only indicative. Exceeding any delivery term does not entitle you to compensation nor the right to cancel your order or terminate the agreement, unless the exceeding of the delivery term is such that you cannot reasonably be expected to maintain the agreement. In that case, you are entitled to cancel the order or terminate the agreement to the extent necessary.

4.b As we use transport companies, we can never guarantee delivery time. Las Fiestas cannot be held liable for this. We expressly ask you never to order at the last moment. Packages are normally shipped daily.

5. Retention of title

5.a The ownership of delivered products only transfers when you have fulfilled all that you owe Party Shop Las Fiestas based on any agreement. The risk regarding the products transfers to you at the moment of delivery.

6. Complaints and liability

6.a You have the obligation to examine upon delivery whether the products meet the agreement. If this is not the case, you must inform party shop Las Fiestas in writing and with motivation as soon as possible and in any case within 3 working days after delivery, or after detection was reasonably possible. 6.b If it is proven that the products do not meet the agreement, party shop Las Fiestas has the choice to replace the products in question with new products upon return or to refund the invoice value.

6.c If you do not wish to accept a product for any reason, you have the right to return the product to party shop Las Fiestas within 3 working days after delivery. Return shipments are only accepted in this case if the packaging of the product is undamaged, whereby the costs for return shipments are at your expense.

7. Orders/communication

7.a Las Fiestas cannot be held responsible for errors in orders or communication arising from technology (such as internet connections)
